Terms and Conditions for Full Payment Upfront - Event Children's Entertainment
These Terms and Conditions ("Terms") govern the agreement between [owered Up Parties ("Company," "we," "us," or "our") and the client ("Client," "you," or "your") regarding the provision of children's entertainment services for events. By booking our services, you agree to comply with and be bound by these Terms.
1. Booking and Payment
1.1. Booking Confirmation: All bookings must be made through our official booking channels. A booking is considered confirmed once the full payment has been received by the Company.
1.2. Full Payment: The total fee for the event must be paid in full at the time of booking. No partial payments or deposits are accepted.
1.3. Payment Methods: We accept payment via [list payment bank transfer or PayPal]. All payments must be made in the currency specified in the invoice.
2. Cancellation and Refund Policy
2.1. Client Cancellation: If you need to cancel your booking, please notify us in writing as soon as possible. Refunds for cancellations are subject to the following conditions:
2.2. Company Cancellation: In the unlikely event that we need to cancel the booking, you will receive a full refund of the amount paid. We are not liable for any other expenses incurred by the Client.
3. Rescheduling
3.1. Client Rescheduling: If you need to reschedule your event, please notify us in writing. We will make reasonable efforts to accommodate your new date, subject to availability. Additional fees may apply depending on the new date and time.
3.2. Company Rescheduling: If we need to reschedule the event due to unforeseen circumstances, we will notify you as soon as possible and offer alternative dates. If no suitable date is available, a full refund will be provided.
4. Services Provided
4.1. Entertainment Services: We agree to provide the children's entertainment services as described in your booking confirmation. The exact nature and duration of the entertainment will be as specified in the agreement.
4.2. Substitutions: We reserve the right to substitute performers or entertainment activities with equivalent options if necessary.
5. Client Responsibilities
5.1. Event Venue: The Client is responsible for providing a suitable venue for the entertainment, including any necessary permissions, facilities, and safety measures.
5.2. Supervision: The Client must ensure that adequate adult supervision is provided during the event. Our entertainers are not responsible for supervising children.
5.3. Health and Safety: The Client must inform us of any allergies, medical conditions, or special requirements of the children attending the event. The Client must also ensure that the venue complies with health and safety regulations.
6. Liability and Insurance
6.1. Liability: We are not liable for any loss or damage to property or injury to persons caused by actions or omissions of the Client, guests, or venue staff.
6.2. Insurance: The Company holds public liability insurance. Proof of insurance can be provided upon request.
7. Use of Media
7.1. Photography and Videography: We may take photographs or videos during the event for promotional purposes. If you do not wish for your event to be photographed or recorded, please inform us in writing prior to the event.
8. Amendments
8.1. Changes to Terms: We reserve the right to amend these Terms at any time. Any changes will be communicated to you in writing and will apply to future bookings.
By making a booking and paying the full fee upfront, you acknowledge that you have read, understood, and agree to these Terms and Conditions.

9. Right to Leave
9.1. Feeling Threatened: If the performer feels threatened, unsafe, or uncomfortable at any point during the event, they have the absolute right to leave immediately. The safety and well-being of our performers are our top priority.
9.2. Non-Refundable: If the performer decides to leave due to feeling threatened or unsafe, the client will not be entitled to any refund. This policy is in place to ensure that our performers are not put at risk under any circumstances.
10. Damage
10.1. Client Responsibility for Damage: We understand that accidents can occur, but the client may be held responsible for excessive damage sustained to the costumes and property of Powered Up Parties during the event. This includes any intentional or unintentional harm caused to our costumes, props, or other materials.
10.2. Cost of Replacement/Repair: In the event of damage or breakage, the cost to repair or replace damaged or broken costumes, props, or materials will be billed directly to the client. We will provide an itemized invoice detailing the costs incurred, and prompt payment will be required to
cover these expenses.
11. Allergies and Safety
11.1. Client Responsibility: If you have booked a face painter or glitter tattooist as part of your package, it is the client’s responsibility to ensure that no child at the event has any allergies or sensitivities to the products used. Powered Up Parties will make reasonable efforts to use safe and high-quality products; however, we cannot guarantee that no allergic reactions will occur. The client understands and agrees that Powered Up Parties is not liable for any injuries or allergic reactions that may happen during the event.
11.2. Age Restrictions for Glitter Tattoos: For health and safety reasons, Powered Up Parties is unable to provide glitter tattoos to children under the age of 3, even with parental or guardian consent. This policy is in place to ensure the well-being of young children and to comply with safety regulations.
Please ensure that all relevant information regarding allergies and age restrictions is communicated to us prior to the event to help us deliver a safe and enjoyable experience for everyone.
Payment Details
1. Confirmation of Booking
1.1. Booking Fee Receipt: Once we have received the booking fee from the client, Powered Up Parties will send a confirmation email. This email will include the client's details and the remaining balance due for the event.
